论世界贸易组织反倾销产业损害确定的若干法律问题

【摘要】:反倾销制度是世界贸易组织认可并许可使用的贸易保护措施之一,因其启动简便、作用有效、直接且隐蔽的特点,日益得到各成员方的普遍重视和频繁援用。反倾销制度的目的在于抵制对进口方国内产业造成损害的倾销,而非普遍地打击倾销本身。反倾销措施的启动须以调查机关对倾销进口产品致使国内产业遭受损害的肯定性结论为前提。因此,产业损害确定的相关问题在反倾销调查中意义重大,它不仅是调查的核心内容,更是限制反倾销措施滥用的重要环节。 中国作为WTO成员方,反倾销立法及实践均须符合WTO规则。为此目的,制度上明确《反倾销协定》第3条“损害确定”的含义是充分运用国际规则的前提。调查机关对事实、数据的深入挖掘与审慎分析则是规则得以适用的必要条件,也是合理利用国际反倾销法律制度,维护进口国产业良好发展环境、合法利益及全球公平贸易秩序的重要环节。 本文立足WTO《反倾销协定》现有规则的合理性及通行解释,以求对《反倾销协定》规则中的模糊与不确定性之处加以明晰。文章亦将从实践的视角和操作的层面关注和讨论如何描述、体现倾销损害,,以得到争端解决机构的采纳与认可。并在此基础上结合中国的反倾销立法和实践,对有关问题提出改进的参考方案。 本文的论述逻辑如下: 第一章介绍倾销、反倾销的含义、特征;产业损害确定的概要内容,及其在反倾销中的制度价值,为后文的展开提供框架。 第二章通过分析同类产品与国内产业来构建产业损害对象的确立标准。 第三章在总结WTO争端解决机制及成员方实践的基础上,对产业损害审查(包括实质损害、实质损害威胁和实质阻碍)的具体因素和要求进行解释和明确,并探讨了累积评估的适用。 第四章通过比较WTO框架下规则标准的变迁及中国实践经验,探讨了倾销进口产品与国内产业损害间因果关系程度及真实性的标准问题,并讨论了中国运用策略上的转变。 第五章以欧盟的实践为例,对计算方法进行了简要介绍,并探讨中国采纳适用的可能性及步骤问题。 结论部分提出了多边谈判对WTO反倾销制度产业损害确定规则与落实的一些阻碍;并总结了各章关于中国立法和实践完善的要点。
[Abstract]:Anti-dumping system is one of the trade protection measures approved and permitted by the World Trade Organization. Because of its simple, effective, direct and hidden characteristics, anti-dumping system has been paid more and more attention to and frequently invoked by all members. The purpose of anti-dumping system is to resist dumping which causes harm to the importer's domestic industry, rather than to attack dumping itself. The initiation of anti-dumping measures must be based on the positive conclusion that the domestic industry is injured by dumping imported products. Therefore, the problems related to the determination of industrial damage are of great significance in the anti-dumping investigation, which is not only the core content of the investigation, but also an important link to limit the abuse of anti-dumping measures. As a member of WTO, China's anti-dumping legislation and practice must conform to the WTO rules. To this end, the institutional clarification of the meaning of "damage determination" in Article 3 of the Anti-dumping Agreement is a prerequisite for the full application of international rules. The thorough excavation and careful analysis of the facts and data by the investigating organs are the necessary conditions for the application of the rules, and are also necessary for the rational use of the international anti-dumping legal system and for the maintenance of a sound environment for the development of industries in importing countries. This paper is based on the rationality and general interpretation of the existing rules of the WTO Anti-dumping Agreement in order to clarify the ambiguity and uncertainty in the rules of the Anti-dumping Agreement. The article will also focus on and discuss how to describe dumping injury from the perspective of practice and operation, so as to obtain the adoption and approval of the dispute settlement body. On the basis of this, combined with China's anti-dumping legislation and practice, this paper puts forward some suggestions for improving the relevant issues. The logic of this paper is as follows: the first chapter introduces the meaning and characteristics of dumping, anti-dumping, the summary content of industrial injury determination and its institutional value in antidumping, which provides a framework for the later part. The second chapter constructs the establishment standard of industry damage object by analyzing the similar products and domestic industries. On the basis of summing up the WTO dispute settlement mechanism and the member parties' practice, the third chapter explains and clarifies the specific factors and requirements of the industrial damage examination (including substantial damage, material damage threat and material hindrance). The application of cumulative assessment is discussed. By comparing the changes of rules and standards under the framework of WTO and China's practical experience, the fourth chapter discusses the standard of causality and authenticity between dumped imported products and domestic industrial injury, and discusses the transformation of China's application strategy. In chapter 5, taking the practice of European Union as an example, the calculation method is briefly introduced, and the possibility and steps of China's adoption are discussed. In the conclusion part, the author puts forward some obstacles to the establishment and implementation of the rules of multilateral negotiation on the industrial damage of WTO anti-dumping system, and summarizes the key points of the perfection of China's legislation and practice in each chapter.
