手续的规制与构造的路径——劳动形态多元化背景下集体协商机制的完善

【摘要】:世界范围内的劳动法的改革正在加速进行。最初由大量生产、大量消费型的工业化社会所形成、发展的传统劳动法,已经不能适应近年来社会的复杂化和国际化带来的劳动形态多元化。目前有两种新的法学理论引人注目,一是欧洲的"手续的规制"理论,二是美国的"构造的路径"理论。前者以政治哲学为基础,后者以经济学为基础加以思考和构成。虽然基石不同,但都倡导对应劳动社会的多样化、复杂化的实态进行新的理论建构,并在劳资协商中重视这种动态的发展过程。两种理论并非互相排斥,而是相互补充与融合,以实现劳动社会的公正和效率。借鉴上述理论,结合我国劳动法制的现状,有必要在劳动形态多元化背景下建立反映各种劳动者意见的分权的协商机制,同时劳动法的规制内容自身应由国家详细制定的事前规则向重视当事者的集体协商的事后规则转变。
[Abstract]:The reform of labor laws around the world is accelerating. The traditional labor law, which was formed by mass production and mass consumption, has been unable to adapt to the complexity of society and the diversification of labor patterns brought about by internationalization in recent years. At present, there are two kinds of new legal theories, one is the "formality regulation" theory in Europe, the other is the "constructive path" theory of the United States. The former is based on political philosophy, while the latter is based on economics. Although the foundation stone is different, they all advocate the diversification of corresponding labor society, the complex reality carries on the new theory construction, and pays attention to this kind of dynamic development process in the labor consultation. The two theories are not mutually exclusive, but complement and merge each other in order to realize the justice and efficiency of labor society. Referring to the above theory and combining the present situation of labor legal system in our country, it is necessary to establish a decentralized consultation mechanism reflecting the opinions of various kinds of workers under the background of diversified labor forms. At the same time, the regulation content of the labor law itself should be changed from the prior rules formulated by the state in detail to the ex post rules which attach importance to the collective negotiation of the parties concerned.
