农村“两权”特殊性及抵押处置问题研究

【摘要】:正在我国银行不良资产处置实践中,商业银行往往在区分不同不良资产基础上,采取直接催收、协议处置、借新还旧、实现担保抵押权、诉讼清收、打折清收、不良资产打包出售、债务战略重组、债转股、不良资产证券化、呆账核销等方式处置不良资产。对于抵押类不良资产,除直接清收、借新还旧、债务战略重组、债转股、不良资产证券化、呆账核销外,其余处置方式都或多或少地涉及抵押财产的处置。具体到农村承包土地经营权和农民住房
[Abstract]:In the practice of disposal of non-performing assets of banks in our country, commercial banks often adopt direct collection, agreement to dispose, mortgage right, litigation collection, discount collection on the basis of distinguishing different non-performing assets. Non-performing assets package and sale, debt strategic restructuring, debt to equity, non-performing asset securitization, write-off of bad debts and other ways to dispose of non-performing assets. For non-performing mortgage assets, the disposal of mortgage assets involves, more or less, the disposal of mortgaged property, except for the direct liquidation, new repayment, debt strategic reorganization, debt-to-equity conversion, non-performing asset securitization, and write-off of bad debts.
